Terms of Service

Welcome to Findell! These Terms of Service ("Terms") govern your use of the Findell mobile application and related services provided by WayBetter Technologies LLC ("Findell," "we," "us," or "our"). By using Findell, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and a U.S. resident to use Findell. By creating an account, you represent that you meet these requirements and that the information you provide is accurate.

2. Account Registration

• You must provide accurate, complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity under your account.
• Notify us immediately at support@findellapp.com if you suspect unauthorized access.

3. Services Description

Findell provides:

• AI Financial Coaching: Personalized guidance from Vera (wellness), Rex (debt), and Nova (investing).
• Bank Account Linking: Via Plaid, to analyze your transactions and provide insights.
• Financial Health Score: A proprietary score based on your financial behaviors.
• Findell Academy: Educational modules on personal finance topics.
• Weekly Reports: Summaries of your financial activity and progress.

4. Subscription Plans and Billing

4.1 Free Plan

Includes limited AI messages, basic budgeting, and 3 Academy modules at no cost.

4.2 Pro Plan ($9.99/month)

Includes unlimited AI messages, Rex coach, full Academy access, advanced analytics, and more.

4.3 Premium Plan ($19.99/month)

Includes everything in Pro plus Nova coach, investment tracking, family sharing, and priority support.

4.4 Billing

• Subscriptions are billed through Apple App Store or Google Play Store.
• Subscriptions auto-renew unless canceled at least 24 hours before the renewal date.
• Manage or cancel subscriptions in your device's app store settings.
• No refunds for partial billing periods, except as required by law or app store policies.

5. Plaid Integration

By linking bank accounts, you authorize Plaid Inc. to access your financial data on our behalf. Review Plaid's Terms. You may disconnect accounts at any time in app settings. We do not store your bank login credentials.

6. Acceptable Use

You agree NOT to:

• Use Findell for any illegal purpose or to violate any laws.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Reverse engineer, decompile, or disassemble the app.
• Use automated systems (bots, scrapers) to access the service.
• Transmit malware, viruses, or harmful code.
• Harass, abuse, or harm others through the service.
• Misrepresent your identity or affiliation.

7. Intellectual Property

Findell and its content (including AI coaches, Academy content, logos, and design) are owned by WayBetter Technologies LLC and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. User Content

You retain ownership of content you provide (messages, goals, etc.). By using Findell, you grant us a license to use this content to provide and improve our services. We may use anonymized, aggregated data for analytics and product development.

9. Disclaimers

IMPORTANT

• Findell is provided "AS IS" without warranties of any kind.
• We do not guarantee the accuracy, completeness, or usefulness of any information provided.
• AI-generated content may contain errors. Always verify important financial information.
• We are not responsible for decisions you make based on Findell's suggestions.
• Bank data accuracy depends on your financial institutions and Plaid.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WayBetter Technologies LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
• Some jurisdictions do not allow these limitations, so they may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless WayBetter Technologies LLC and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of Findell or violation of these Terms.

12. Termination

• You may delete your account at any time through app settings or by emailing support@findellapp.com.
• We may suspend or terminate your account for violation of these Terms or for any reason with notice.
• Upon termination, your right to use Findell ceases. Sections that should survive (disclaimers, limitations, indemnification) will remain in effect.

13. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive any right to participate in class actions. This agreement is governed by the laws of the State of Delaware.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance of the new Terms.
